ARTICLE 1 - Purpose:

PRIMMOCONSEIL N.V., registered in Brussels under company number BE0416.498.303, with its registered office at 101 Bosniëstraat, 1060 Brussels, is the owner of the beCHARGE brand and the website www.beCHARGE.be and is hereinafter referred to as beCHARGE. beCHARGE organizes contests that are accessible via various media (radio, internet, mobile, etc.).

ARTICLE 2- Rules:

These contests are organized by beCHARGE, either on its own or in collaboration with various partners, but their terms and conditions are uniform and comply with the terms of these rules. From time to time, beCHARGE may offer various prizes. These prizes vary depending on the partnership agreements entered into by each of the partners. The prizes are generally purchase codes and discounts that can be redeemed on the beCHARGE.be website or prizes offered by the partners. These rules are valid for an indefinite period, unless beCHARGE decides otherwise. The General Rules are available upon request from beCHARGE. However, beCHARGE reserves the right to suspend, cancel, modify, or postpone the contests organized under these rules at any time and without prior notice, at its sole discretion and, in particular, according to its needs. The contest ends no later than the announced date or when all described prizes have been awarded.

ARTICLE 3 - Participation:

The contests organized under these rules are open to any adult individual, with the exception of beCHARGE employees and their family members, as well as the partners offering the prizes or their employees and family members. Any minor participating in a game is deemed to have obtained prior consent from their parents. The awarding of prizes to minors requires the prior written consent of one of their parents. Otherwise, the prize cannot be awarded. It is possible to play only once and win only once per game session and per household (same name, same address, or two different names living at the same mailing address). A game session is an announced play period with a title specific to each session, featuring a special prize. Participation on behalf of third parties is not permitted. People living together are considered a single household, even if they have different names but the same address. Participation in the game is free. 3.1 How to Participate: Prizes can be won as follows: - Online: By sending an email or filling out an online form, in accordance with the terms and conditions listed on the relevant website. - Or in person: If the partner is a radio station, through the station’s standard procedures and as directed by the host when the contest begins. 3.2. Game launch: The game can be launched in one of the following two ways, either individually or in combination: Either on one of the partner radio stations. Or on the website or one of the participating social media platforms.

ARTICLE 4 - Prices:

The value of each prize offered may vary. It is non-refundable under any circumstances and cannot be replaced by a prize of equivalent value without the winner’s consent. beCHARGE reserves the right, in the event of circumstances beyond its control and if circumstances so require, to replace the prizes with prizes of equivalent value and with comparable characteristics. Under no circumstances may claims give rise to any compensation or financial equivalent. beCHARGE reserves the right, within the framework of the contest, to replace the prize with one of equivalent nature if, for any reason, it is unable to award the announced prize. beCHARGE cannot be held liable for events beyond its control, such as local, state, or international health or safety restrictions. Neither participants nor winners may claim any substitute prize or financial equivalent. In the event that beCHARGE or its partner is unable, for any reason, to award the announced prize to the winner, they reserve the right to extend the deadline for awarding the prize as necessary, within a period of one year following the date on which the winner was notified of the prize. When the prize is presented to the winner, beCHARGE cannot be held liable for any misappropriation, damage, theft, or loss of the prize on that occasion. beCHARGE’s obligation consists solely of making the prizes available. Consequently, and unless expressly provided for in the prize descriptions, all additional costs associated with these prizes or general costs associated with taking possession of the prizes—in particular, travel expenses to their destination, catering costs, accommodations, vehicle registration, insurance related to the use of the product or service (etc.)— shall be borne by the winners. No payment or reimbursement is due in this regard. beCHARGE accepts no responsibility whatsoever for the quality or performance of the prize. Any damage or adverse consequences resulting from the use of the prize may not be reported or contested by the recipient. Under no circumstances shall beCHARGE be held liable for the time required to deliver the prizes to the winners or in the event that the winners are unable to enjoy their prizes due to circumstances beyond beCHARGE’s control. If, after being contacted by beCHARGE, the winner is unable to claim the prize for reasons beyond beCHARGE’s control within a period of two (2) months from the date of contact, beCHARGE reserves the right to award the prize to another participant, selected at random, under the same conditions as described in these rules. beCHARGE communicates via email and does not ship prizes by mail at its own expense. It is the winner’s responsibility to come to beCHARGE’s headquarters in Brussels to claim his or her prize. beCHARGE expressly disclaims any liability for incidents or damages of any kind that may arise from the possession, enjoyment, or use of the prize, which the winners expressly accept.

ARTICLE 5 - Winner:

Each person participating in the game will be notified that they have won: either personally via email, or through an electronic announcement on the relevant website, or through a combination of the above methods. In addition, a person may not win more than once per game.

ARTICLE 6 - Identity Verification:

In order to award the prize to the winner, he or she may be asked to provide proof of identity to ensure that the prize is not awarded to a third party impersonating him or her. The winner has (2) two months from the date of notification of his or her win to provide all proof of identity. After two months, the prize will be automatically forfeited. Without these documents, the person posing as the winner cannot claim a prize, and the winner cannot compete for or claim a prize. Only one prize will be awarded per winner. Furthermore, beCHARGE cannot be held liable for the processing of the winners’ last and first names, and in particular for any errors or omissions in the reservation of the seat(s) or the shipment of the prize, which may be attributable to the trade show organizers and, more generally, to any of beCHARGE’s partners, as well as for any subsequent use they may make of the data relating to the winners (in particular, commercial solicitations). By accepting their prize, participants grant beCHARGE permission to use their last name, first name, and likeness in the form of a photo or video, without any restrictions or reservations, except as provided in Article 9 below, and without this entitling them to any compensation, rights, or benefits other than the prize awarded to them. This allows beCHARGE to freely publish the list of winners on its websites or social media platforms and, if desired, display their photo or video. PARTICIPANTS’ RIGHTS REGARDING THEIR DATA All participants have the right to access, correct, and delete their personal data. Under the GDPR, you have the right to obtain information about your stored personal data free of charge. You also have the right to rectification, erasure, and restriction of the processing of your personal data. If you object to data processing, this objection remains valid for the future, unless the controller demonstrates that there are compelling legitimate grounds for the processing that override the interests of the data subject.

ARTICLE 7 - Convention on Evidence:

Unless there is a manifest error, the information provided by the gaming systems and, more generally, by all of beCHARGE’s telematics services shall be considered conclusive evidence in any dispute concerning the connection elements and the computer processing of information related to the game.

ARTICLE 8 - Liability:

Under no circumstances may beCHARGE be held liable for the prizes it awards to the winners of the Contest, whether with respect to the quality of the prizes compared to the quality announced or expected by the Contest participants, their shipment and delivery to the winners (in particular the risks of spam, loss, theft, and, more generally, any damage the prizes may sustain) or any damage of any kind that the prizes may cause, regardless of whether such damage is directly or indirectly attributable to the prizes. beCHARGE also reserves the right, if necessary, to cancel the Game, one or more game sessions, registrations for the Game, or the awarding of all or part of the prizes, in whole or in part, if it believes that malfunctions and/or fraud have occurred in any form whatsoever and from any source whatsoever—in particular technical, electronic, or computer-related—in connection with participation in the Game or the determination of the winner(s). beCHARGE reserves the right to shorten, extend, modify, or cancel the game. It cannot be held liable in the event of an unforeseen circumstance or force majeure that requires a change to this game. beCHARGE also reserves the right to exclude from participation in this game any person who disrupts the proper conduct of the game and to take legal action against anyone who cheats, commits fraud, or disrupts or attempts to disrupt the operations described in these rules. In general, fraud or an attempt at fraud, in any form and for any purpose, will result in disqualification from the Contest, provided that no compensation will be awarded as a result. Any winner who has committed fraud, attempted to commit fraud, or benefited from such an act will automatically be disqualified from receiving the prize or prizes won. Participation implies knowledge of and acceptance of the characteristics and limitations of the Internet and mobile phones, the lack of protection for certain data against possible misappropriation or piracy, and the risk of infection by any viruses circulating on the Internet and/or mobile phone networks. All participants grant the company organizing the game permission to publicly disclose their first and last names, their voice, or their likeness through video, audio, or digital media for a period of one year from the date the game session ends, without this use giving rise to any compensation.

ARTICLE 9 - General Provisions:

Participation in the competitions implies full acceptance of the provisions of these rules. Any difficulties arising from the application or interpretation of these rules, or any matters not covered herein, shall be resolved in the final instance by the contest organizer, whose decision is final, and the listener accepts this decision without the right to contest it. Any claim or dispute, of any nature whatsoever, by a winner or non-winner must be sent by email to beCHARGE’s headquarters within 30 calendar days of the closing date of the game session. Only Belgian law applies to the contests organized under these rules. In the event of a dispute, the Commercial Court of Brussels shall have exclusive jurisdiction. Participants waive any right to claim against the organizers regarding the terms and conditions of the contest, its conduct, or its results.
